For those of us that don’t follow the auto insurance industry when a state goes from “no fault” to a tort system it
could be devastating to drivers. Just ask Artie and Linda Gibbard who were in a serious accident last year. Artie spent
months out of work and even though the other driver was convicted of reckless driving, the couple hasn’t gotten any
money from the insurance companies. The only way under a tort system to get the money you’re entitled to is to sue.
That sounds like an American enough way to do things but in the end there are still bills to be paid and people like
Linda and Artie seriously screwed by the system.
