Those who bemoan modern Formula One settling its rivalries in the courtroom instead of on the race track have another set of examples to bring up at the pub as news emerges of the settlement of two lawsuits related to the top-tier racing series have emerged over the course of the weekend.<br />
<br />
In one case, Scuderia Toro Rosso and its dejected driver Sebastien Bourdais reportedly settled a dispute of the premature termination of the contract between the two parties. When the team <a href="http://www.autoblog.com/2009/07/21/officially-official-toro-rosso-confirms-alguersuari-to-replace/">fired Bourdais in favor of Jamie Alguersuari, Bourdais proclaimed</a> that he was looking into legal recourse against the team. Reports now indicate that the two parties settled out of court, with STR reportedly paying Bourdais salary plus damages in the amount of $2.1 million. Speculation is rising that the French driver will return to racing in the U.S., where he racked up an unprecedented four consecutive Champ Car titles before his ill-fated move to Formula One.<br />

Meanwhile, departing FIA president Max Mosley has reportedly settled his case against German newspaper <em>Bild</em> over the publication of his <a href="http://www.autoblog.com/2008/03/30/fia-chief-max-mosley-embroiled-in-sandm-sex-scandal/">sordid sex scandal</a> for which he sued the publisher for $2.35 million. According to reports, Mosley and <em>Bild</em> settled for $290,000 which will be distributed to two charities, as well as the publication of an interview to clear the record. The settlement follows the $100,000 in damages and $760,000 in legal fees <a href="http://www.autoblog.com/2008/07/24/fia-president-max-mosley-gets-off-judiciously/">awarded last year</a> to Mosley from the <em>News of the World</em>, the British tabloid which originally broke the story.<br />

The Frenchman has been touted as a potential head of the international motorsport governing body and automobile federation for years, with <a href="http://www.autoblog.com/2008/03/20/rumormill-ex-ferrari-ceo-jean-todt-for-fia-president/">rumors intensifying following his resignation</a> from the top spot at Ferrari over a year ago. However, reports now indicate that the renowned racing strategist will stand for the office to replace the departing Max Mosley.<br /><br />Todt has a wealth of experience in a variety of motorsport disciplines. After a brief career as a rally co-pilot, Todt went on to head up Peugeot's racing program, bringing the French automaker titles at Le Mans, Dakar and the World Rally Championship. He then went on to head the Scuderia Ferrari F1 team, orchestrating an unprecedented winning streak together with Michael Schumacher and Ross Brawn. Todt was eventually named chief executive of the entire Ferrari operation, a post from which he <a href="http://www.autoblog.com/2008/03/18/breaking-jean-todt-steps-down-as-ferrari-ceo/">stepped down last year</a>, while retaining certain influential positions for Ferrari including his seat on the FIA World Motorsport Council. <br /><br />The son of a Holocaust survivor, Todt's family history appears at odds with Mosley's, to say nothing of <a href="http://www.autoblog.com/2009/07/07/followup-ecclestone-fans-flames-again-reportedly-blames-jews-f/">Bernie Ecclestone's recent comments</a>. But that didn't stop Mosley from endorsing Todt (or Todt from accepting Mosley's endorsement) as his successor when he <a href="http://www.autoblog.com/2009/07/15/mosley-reportedly-says-he-wont-seek-sixth-term-as-fia-president/">finally announcing his intention yesterday not to seek re-election</a> this coming October. <br /><br />Todt has already assembled part of his 22-member slate, including New Zealand's Brian Gibbons and Britain's Graham Stoker as vice-presidents and American Nick Shaw, current FIA deputy president, to preside over the FIA Senate. According to Ecclestone, "It's a pity they didn't sort the banks out.... They have a lot of influence everywhere." He would go on to add that his colleague - FIA president Max Mosley, the fascist leader's son who made headlines for allegedly engaging in a <a href="http://www.autoblog.com/2008/03/30/fia-chief-max-mosley-embroiled-in-sandm-sex-scandal/">Nazi-themed S&amp;M orgy</a> with several prostitutes - would make a good prime minister. <br /><br />In addition to protests lodged by Jewish organizations worldwide, elements within Germany have publicly stated that they are appalled by Ecclestone's comments, which come just days before the start of the German Grand Prix. Government officials in Germany have already <a href="http://www.autosport.com/news/report.php/id/76746">canceled meetings with Ecclestone</a>, while some have speculated that the series' German teams - which include McLaren-Mercedes and BMW Sauber as well as the Cologne-based Toyota team - could boycott Ecclestone's leadership, whatever practical implication that would have. <br />It's all or nothing for the Formula One Teams Association. The body representing the majority of the teams is still in the process of negotiating with the FIA over the proposed drastic budget cuts, but insists that the FIA has to take all of them or none of them. If Max Mosley's budget cuts are imposed as planned, Ferrari, McLaren, BMW, Renault, Toyota, Red Bull and Toro Rosso say they will all pick up and leave, and take with them many of the sport's best drivers. Two-time World Champion <a href="http://en.f1-live.com/f1/en/headlines/news/detail/090608150035.shtml">Fernando Alonso</a> and reigning World Champion <a href="http://en.f1-live.com/f1/en/headlines/news/detail/090608180418.shtml">Lewis Hamilton</a>, along with Felipe Massa, Nick Heidfeld, Mark Webber and Jarno Trulli have all pledged to follow their teams out from under the FIA's purview. But where will they all go? To a new break-away series.<br /><br />The teams have threatened to leave the FIA Formula One World Championship before, but this time, things are getting serious. According to the latest reports, FOTA has already begun negotiations with Dorna Sports in anticipation of Mosley's rejection of their counter-proposal. The chief executive of Dorna, the company that runs F1's two-wheeled counterpart MotoGP, has reportedly agreed to run the new series for the break-away F1 teams. A few years ago, Dorna managed to wrestle the rule-making authority away from the Federation Internationale de Motocyclisme - the FIA's motorcycling equivalent - and place it in the hands of the manufacturers. Last year, it looked like he'd be<a href="http://www.autoblog.com/2008/06/03/eccelstone-calls-for-mosley-to-step-down/"> forced out of his position</a> at the head of the motorsport governing body, while this year he's been at the source of <a href="http://www.autoblog.com/2009/05/17/f1-standoff-update-mosley-drops-two-tier-system-ferrari-takes/">controversy over new regulations</a> that could yet see the majority of the teams in Formula One walk out. But few are as appalled by Mosley's leadership as Jody Scheckter.<br /><br />The 59-year-old 1979 F1 World Champion, who remained Ferrari's last champion until the Schumacher era, has admitted that the FIA's leadership, which he characterized as a dictatorship gone wrong, has caused him to consider handing back his title. <br />With the May 29 deadline for registering for the 2010 Formula 1 season fast approaching and the bulk of the current teams threatening to walk out of the series, FIA chief Max Mosley and F1 commercial director Bernie Ecclestone met in London on Friday with the heads of each Formula One team to iron out a deal that would allow the sport to accelerate past the standoff and into the next season. But the Japanese team based in Germany - currently enjoying its best season so far - isn't the only one making noise. Ferrari has hinted it could jump ship and put its energy into Le Mans, instead. Mercedes-Benz has said it could cancel its F1 program, and BMW has reportedly done the same. Now, three more teams are joining the call for the proposed regulations to be annulled, or else.<br /><br />Next up to the plate is Red Bull, which owns and operates both the Red Bull Racing and Scuderia Toro Rosso teams. Owner Dietrich Mateschitz has joined the ranks of disgruntled team owners, saying he will not field his two teams next season under the proposed regulations. <br /><br />Renault has not quite gone that far, but team principal Flavio Briatore has said that the rules need to be changed, the fashion king comparing the FIA's proposal to opening discount stores on trendy streets. The FIA has set May 29 as the deadline for teams to sign up and pay their fees to race in 2010, but with Ferrari, McLaren-Mercedes, BMW Sauber, Red Bull, Toro Rosso and Renault threatening boycott, that leaves only Williams, Force India and Brawn GP lining up on the grid next year. Those three are expected to go ahead regardless, because as independent F1 teams, if they withdrew or sat a season out, they would have no other obvious places to race. <br /><br />Even with <a href="http://www.autoblog.com/2009/04/23/formula-shuffle-lola-aston-martin-reportedly-considering-f1-en/">several new teams lining up to join</a> the field next year, Mosley can't seriously hold his ground against all the sport's biggest teams... can he? Earlier this year, he pledged that when his term ends next year, he would step down - and that was before the infamous <a href="http://www.autoblog.com/2008/03/30/fia-chief-max-mosley-embroiled-in-sandm-sex-scandal/">sex scandal</a>. Yet even after the turpitude, Formula One supremo Bernie Ecclestone - whose <a href="http://www.autoblog.com/2008/12/23/bernie-ecclestone-wishes-you-a-merry-christmas-at-max-mosley/">Christmas card</a> brought the whole thing up again - noted there was <a href="http://www.autosport.com/news/report.php/id/67985">no way</a> that Max would step down, saying, "I've always said that Max will be the president until he dies" because he believes Mosley enjoys confrontation and power.<br /><br />From the looks of it, Mosley is beginning to prove Ecclestone correct. The FIA president has now said that he will wait until next June to decide whether he will step down or not. That's only three months before his term ends, and unless a challenger decides to campaign while Mosley deliberates, it's unlikely that 90 days would be enough to unseat Lord Mosley. According to Ecclestone, Mosley won the vote of confidence after the sex scandal after <a href="http://slam.canoe.ca/Slam/Motorsports/2008/06/06/5792676-sun.html">bribing representatives from third world countries</a> to back him. After what was described as an unprecedentedly unanimous meeting of team principals under the newly formed <a href="http://www.autoblog.com/2008/07/31/f1-teams-meet-form-new-association-in-maranello/">Formula One Teams Association</a>, Ferrari's <a href="http://www.autoblog.com/2008/08/05/montezemolo-named-head-of-formula-one-teams-association/">Luca di Montezemolo</a> and Toyota's John Howett met with our favorite whipping post, Max Mosley, on neutral ground in Geneva to discuss alternatives.
<p>Although the only official word following the meeting Tuesday in Geneva is that the discussions were constructive, reports indicate that considerable agreements were reached towards bringing down the costs of participation in Formula One without having to resort to spec engines. Among those measures reported include the life of each engine being expanded from the current two-race requirement to three and a requirement for each manufacturer to offer 25 engines for purchase by independent teams at 10 million euros per unit. Nothing has been officially announced yet, but the representatives are expected to meet again after the season's conclusion at the upcoming Brazilian Grand Prix to further discuss the arrangements, which are tipped to be stop-gap measures for the coming two seasons while the FIA comes up with more reasonable proposals for the long term.</p>

<p>Rumors have been circulating that CVC, the commercial rights holders to Formula One, have considered selling the series. But before that could happen, they would have to give Bernie Ecclestone the boot.</p>
<p>The reports were fueled by comments made by Max Mosley, the embattled president of the FIA, who related to reporters that conversations about the subject had taken place with executives at CVC. According to Mosley's conclusion, CVC would consider selling Formula One if a huge offer were made - possibly by an Arab consortium - but Ecclestone would need to be replaced because "the whole business depends on a man who is 78 years old". However, CVC issued a strong statement at <a href="http://www.autoblog.com/2008/08/04/spoiler-alert-hungary-for-points-upsets-and-surprises-at-the-mag/">this past weekend's race in Hungary</a> that it had no immediate plans to sell F1 and was pleased with its performance as well as that of Bernie Ecclestone.</p>

<p>Remember the good old days when a prominent chief executive would have disappeared into obscurity after having been exposed by the newspapers? Well those good old days are gone, and Max Mosley is happy for it.</p>
<p>It's been a long and hard road for Max Mosley, but the embattled FIA president seems well suited for the ordeal. Mosley was <a href="http://www.autoblog.com/2008/03/30/fia-chief-max-mosley-embroiled-in-sandm-sex-scandal/">caught on film</a> partaking in what was described as a Nazi-themed S&amp;M orgy with several prostitutes. He then survived a <a href="http://www.autoblog.com/2008/06/03/sorry-bernie-mosley-wins-vote-of-confidence/">vote of no confidence</a> in his leadership in the motorsport governing body, and launched a lawsuit against the <em>News of the World</em>, the British tabloid that broke the story. The judge returned the verdict from that lawsuit today, awarding Mosley &pound;60,000 in exemplary damages, plus an additional estimated &pound;1 million in expenses. </p>
<p>Mosley's case hinged on the right to privacy, and upon receiving the judgment (so to speak), the prototypical auto-erotic figure noted that he hoped the ruling would serve as a deterrent for other publications from pursuing "this type of invasive and salacious journalism". The moneys awarded by the court won't go into Mosley's pocket, as they're earmarked towards the road safety and environmental work undertaken by the FIA Foundation.</p>

<p>According to the latest reports, <a href="http://www.autoblog.com/2008/04/03/persona-non-grata-carmakers-attack-mosley-as-kinky-fia-prez-is/">FIA president Max Mosley</a> received ample warning that there were those out to expose and discredit him, but Mosley did nothing to alter his <a href="http://www.autoblog.com/2008/03/30/fia-chief-max-mosley-embroiled-in-sandm-sex-scandal/">bizarre sexual activities</a> in light of the development. The news stems from a Times interview with industrial espionage expert Dean Attew, who claims he had been approached by parties seeking Mosley's embarrassment and removal from office. Attew, who co-founded Titon International with former special forces commander Major-General John Holmes - a business intelligence consultancy that made the news two years ago when former KGB agent Alexander Litvinenko was poisoned by radioactive Polonium 210 - said that he communicated the information to his former colleague, Bernie Ecclestone, who in turn informed Mosley personally. However, Mosley apparently did not take the warnings seriously and was still caught red-handed and -cheeked two months later.</p>

In the same letter, however, Mosley pledged to fight the allegations and remain in his position despite mounting calls for his resignation.

<p>Mosley dismissed the claim that his <a href="http://www.autoblog.com/2008/03/30/fia-chief-max-mosley-embroiled-in-sandm-sex-scandal/">now-infamous sexual activities</a> had any Nazi connections and pointed to a "covert" operation to discredit him undertaken by persons as yet unidentified through a private investigation firm. The big question is in whose interest would it have been to embarrass Mosley in such a public manner, and the list is long as the FIA president remains a highly controversial character. <p>Despite Bernie Ecclestone's initial support of his colleague Max Mosley, Ecclestone is now publicly urging the embattled FIA president to cancel his planned trip to Bahrain to oversee the grand prix there this coming weekend.</p>
<p>The humiliation which Mosley apparently pursued in a <a href="http://www.autoblog.com/2008/03/30/fia-chief-max-mosley-embroiled-in-sandm-sex-scandal/">disturbing sexual escapade</a> involving multiple prostitutes in a sado-masochistic nazi-themed orgy was outdone only by the embarrassment which resulted from the public revelation of the episode in the British tabloids. Following the news breaking, Mosley declared he would proceed as normal as if nothing had happened, but Ecclestone says his colleague should think again. Citing public opinion and predicting that the royal family in Bahrain "wouldn't like it" if he came to their country, Bernie expressed concern that the news at the event would be dominated (pardon the expression) by Mosley's scandal instead of remaining focused on the race itself. Mosley's "business as usual" approach may require some further thought, to say the least. <em>Thanks for the tip, Schwag of Tulsa!</em></p>

Have for years. We believed it was the pinnacle of motorsport, and by golly each team had the stratospheric budget to prove it. There was a time when a single top team in F1 spent enough to run 12 or 13 top dollar teams in IndyCar. Teams have been wanting the costs to come down, which is fine, because we also miss the days when privateers had a punter's chance at winning a race. Bring back the days of Jordans, Saubers, and Tyrells, we say.<br /><br />But we're not so sure about the way the FIA is going about its cost cutting. Max Mosley, FIA president, has said that as of 2009, budgets will be capped. The cap isn't set, nor are the details of what is and isn't included as part of the capped amount. For instance, the team principal, driver, and marketing department, as well as the engine, might not be included in the spending limit. If the teams accept a limit, then they'll get other rewards like additional use of their wind tunnels or more computer time for CFD work.<br /><br />This, along with the 5-year engine freeze (which we still don't understand), is meant to allow teams to operate with a mooted budget amount of $150 million per year. Compared to the nearly $500 million dollars that a team like Ferrari spends, or Toyota's rumored $700 million budget, it will be fascinating to see what teams come up with. It will also be neat to start hearing about the sudden astronomical rise in marketing budgets, and to get a whiff of all those cooked books, because we simply don't believe teams will spare a bit of extra coin when championship silverware is on offer. <p>The restrictions include a complete freeze on engine development for the next ten years. In a speech delivered last week in Monaco at the Motor Sport Business Forum, FIA President Max Mosley (pictured at right) justified the decision by pointing out that the engines developed by F1's six engine suppliers - Ferrari, Mercedes, BMW, Honda, Toyota and Renault - are already evenly matched and incredibly advanced: "There is no need to develop an F1 engine any further." (Heck, let's go back to foot-powered Flinstones-mobiles then.)</p>
<p>The far-reaching restrictions also covered the use of wind-tunnels for the first time in the formula. The new regulations state that each team can only use one wind-tunnel, can only operate it for 15 runs per 8-hour day, no more than five days per week. Further limitations were set on how the wind-tunnel may be used, and to prevent teams from simply switching their personnel over to even more expensive Computational Fluid Dynamics (CFD) simulators, the FIA intends to put a cap on that, too.</p>
<p>Ross Brawn, former technical director at Ferrari and new team principal at Honda, recently pointed out that restrictions like these don't achieve their intended goal of reducing costs, they just force teams to find newer, more expensive ways to gain a performance edge. We'd have to agree with Brawn: you can't contain a competitive spirit, and F1's chock-full of 'em.</p>
