A national law firm, Hagens Berman Sobol Shapiro LLP, has filed a proposed class action lawsuit whose presupposition is that MyFord Touch is defective. Specifically, the complaint states that the system – as well as the MyLincoln Touch and MyMercury Touch clones – often freeze, fail to respond to voice or touch commands and have issues connecting to mobile phones.

According to Hagens Berman managing partner Steve Berman, MyFord Touch is a theoretically "brilliant idea" that falls short in actual execution. Said Berman in a press release, "In reality, the system is fundamentally flawed, failing to reliably provide functionality, amounting to an inconvenience at best, and a serious safety issue at worst."

Other MFT issues enumerated within the 41-page filing include problems controlling the window defroster, rear-view camera and navigation system. The suit maintains that Ford is aware of the problem but has yet to submit a workable and acceptable solution to MFT customers. Scroll down if you'd like to read the full press release.

Ford - MyFord Touch

Date Filed: July 15, 2013
Court: U.S. District Court, Central California
Type of Case: Consumer Protection
Status: Active
Company Name: Ford Motor Company
Hagens Berman has filed a proposed class-action lawsuit alleging that Ford Motor Company's (NYSE: F) MyFord Touch, MyLincoln Touch and MyMercury Touch touchscreen systems are defective, often freezing, failing to respond to voice and touch commands and failing to connect to mobile phones.

The 41-page complaint, filed in the U.S. District Court for Central California, includes a long litany of problems with the system, and details Ford's failed attempts at correcting the system through system updates and other fixes.

Owners of Ford, Lincoln or Mercury vehicles with the MyFord Touch, MyLincoln Touch or MyMercury Touch systems can contact a Hagens Berman attorney to discuss the case by calling (206) 623-7292 or by emailing MyFordTouch@hbsslaw.com.

The systems, introduced by Ford in 2011, promised owners of Ford, Lincoln and Mercury vehicles with the ability to seamlessly operate audio controls, use a GPS navigation system, control climate systems and operate a Bluetooth-enabled device through the system.

"In theory, MyFord Touch is a brilliant idea and worth the premium that Ford charged its customers for the system," said Steve Berman, managing partner of Hagens Berman and one of the attorneys who filed the lawsuit. "In reality, the system is fundamentally flawed, failing to reliably provide functionality, amounting to an inconvenience at best, and a serious safety issue at worst."

According to the suit, the system fails even while controlling crucial vehicle functions, such as the defroster and rear-view camera, which are controlled through the system, putting drivers and passengers at risk.

The complaint also calls out consumer complaints involving the vehicles' GPS navigation system. According to the complaint, the touchscreen will turn off, turn back on with a message saying it is "performing scheduled maintenance" leaving the driver without any directional guidance.

The lawsuit claims that Ford has demonstrated it is aware of the problem, having issued several technical service bulletins and software updates. In addition, the complaint documents a number of consumer complaints in the National Highway Traffic Safety Administration's database, all detailing issues with the touchscreen system.

The lawsuit seeks to represent a class of individuals who are current or former owners of vehicles with the systems installed. It seeks compensation for members of the proposed class for violations of consumer protection laws and breach of express and implied warranties.

Sadly the only people who make money off of these kind of lawsuits are the lawyers.

"No Bluetooth device can be found, SYNC is trying to connect to a previously connected device". I get this all the time, even though my phone shows connected on the Ford display..

Did you purchase the vehicle pre-owned? Go into the settings and delete all phones & then re-pair your phone. Your phone may prompt you for access at this point which you will need to allow. This should fix your issue.

MyMercury Touch? What? I don't think there was such a thing.

Re-flash w/update. Problem solved. Not a single freeze or re-boot in 1.5 years. There are a ton of people who should not touch technology above fire.

Diz, I have hard time believing you have no freeze ups. Although, the updates have improved the system significantly the freeze ups are still, leading some of us on FF forum to believe that it may be underdeveloped/defective hardware causing the freeze ups.

I have had my 13 Focus Ti for 6 months to the day now. Not a single freeze-up. No issues except the occasional not heard voice command. Simple, hit the button and repeat said request.

re-flashed + updated my parents' 2012 Edge + Focus, sill having random freezing and bugs. You're right; some people just shouldn't use technology. Still no issues in my circa 2008-09 PRE-MFT Visteon Ford infotainment system. Some people just shouldn't mess with a good thing?

It is crap even after the "update" I did. Maybe the threat of this will make them do something?

I just don't understand how products this bad make it to market. Obviously somebody at Ford had to have tried MFT before release and knew it was garbage - why release it? Why put something in your cars that makes it worse than if it came with more generic alternatives?

Have you read that overall vehicle satisfaction is higher WITH MFT? Odd how that works.

First I would like to see a source for your claim considering how bad MFT really is and second there's no excuse either way. Chrysler has had it nailed for a while now and if they managed it so well then anyone should be able to get it right.

"often freeze, fail to respond" Does that mean we can also sue Microsoft? How about significant others?

"This is why we can't have nice things: Lawyers." Wouldn't be an issue if they weren't empowered by dumb, short-sighted consumers.

Unless you decide to log drag aaron or mary into this to bring up off-topic incorrect garbage there's not really much to say. Lawsuits mean very little nowadays, especially in America. There was a class action lawsuit put together against Toyota because people thought their cars were defective when the anti-theft steering lock would activate after turning the car off. You should go find yourself a new hobby (or entire life).

Please God, let this lawsuit make. Having one of the cars with MFT was the worst car decision I ever made and left me with almost 10,000 in extra debt because I sold the car to get away from it. Driving and having no control of the central user interface for the vehicle including camera, screen, air, nav, radio, Bluetooth, etc. was in all cases annoying and, in some cases for my family and I, downright dangerous. My fault for selling the car, Ford's fault for selling me a bill of goods filled with a flaming bag of poo. Oh, and Ford's response? Dealer level, it is what it is. Corporate level, we could offer you an extended warranty. Worst corporate followed rough EVER.

The a/c system doesn't get disabled during updates. The only thing that does is the heated/cooled seats if optioned so. Camera? Backup camera I take it? If you need that to drive you already made a huge mistake getting your license. I can do without the radio/nav for the 10 minutes it takes to do an update. So far my MFT equipped (early) 2012 focus has only updated 2-3 times in the course of my ownership.
