On September 22, 2010, a horrific crash on the Bronx approach to the Robert F. Kennedy Bridge in New York City was captured on video. As cars were speeding down the road, a merging tractor-trailer overturned, slid across 3 lanes and rammed a minivan against the median, trapping the driver.

What happened next was truly an act of courage. A man in a black Ford Expedition swerved to the side of the road, got out of his car, checked on both drivers and proceeded to help the occupants out of their vehicles -- right on the side of a busy highway.

That helpful man is Gabriel Leon Hernandez. And he was arrested Wednesday morning for events directly related to the accident.

Hernandez was charged with insurance fraud, grand larceny and falsifying business records, according to the police and The New York Times. Allegedly, Hernandez falsely claimed in the weeks after the accident occurred that he was rear-ended by the truck and duped his insurer into paying $21,000 in medical bills and $1,200 for work on his vehicle.

As you can see in the video below, Hernandez's Expedition was clearly not touched by the truck.



According to police, Hernandez truly did undergo body work on his Expedition, but it was for pre-existing damages. Similarly, he underwent shoulder surgery shortly after the accident, but for an allegedly pre-existing condition. Hernandez, when confronted with the video evidence, claimed he was injured trying to remove an occupant from their vehicle. Police have not stated if they believe that claim.

      yeah he was helpful, but so were the others that ran to help, and yet hes the only one who tried to get away with insurance fraud. so no, it was not cuz he was hispanic, its because hes a criminal. WTF?! hes still one of the people that helped but he is also a crook. he deserves nothing in return for his act of kindness cuz he followed it with greed! trying to use a devastating event to his advantage is sick and he was very fairly arrested!

        We NEVER took "their" land. It wasnt "their" land. An American Indian lives with nature, they do not own it. So that means we didn't "take" their land. Oooor to the victor belong the spoils. Oooor they are not "native" remember the Bering strait. Anyway you look at it who cares. We won they lost.....oooor wait there pueblos get millions in government subsidies....so who lost? Never mind some tribes take care of there people some tribes the elders suck up all the money and screw the tribe. Not for the gov to step in because "they" let the elders do this. Wa wa wa......

      By the way, this should serve as a reminder to drivers who CONSTANTLY drive next to big rigs to DON'T DO THAT. Clearly, no one was riding this truck's flank this time, but I see it so often it boggles the mind how stupid and careless people are. Often, I'm waiting in the rear for the lead car to hurry up and pass the trucker, and I just KNOW the idiot thinks they are the safer driver because they are not "speeding". Sure, but you're right next to a big rig who might not see you, might swerve into you, jack-knife into you or just flat out fall on you. Idiots.
