Well, score one for the little guy. Or, as the case may be, the guy that won an eBay auction, getting himself one helluva mondo deal on a 2009 Dodge Challenger SRT8. To refresh your memory, a Southern California dealer called Glenn E Thomas Dodge Chrysler Jeep had the Challenger in question on eBay. The Buy It Now price was $43,425 and the reserve (according to Glenn E Thomas) was $42,995. Then the dealer lowered the Buy It Now price to $43,425 and suddenly, somehow the reserve disappeared.

That's when Alex (aka Hitman from Challengertalk.com) pounced and won himself a 250-mile SRT8 for the crazy price of $29,100. Only thing is, of course, Glenn E Thomas didn't feel like taking a $14,000 bath and refused to honor the auction. Their argument was that they didn't intend to remove the reserve and, in fact, they may not have removed it. They contend that there may have been a glitch in eBay's software. Glenn Dodge did offer to meet Alex halfway, promising him a great deal on the Challenger of his choice, but Alex hung tough, demanding the car he won. It seemed as if the two sides had reached the kind of impasse that can only be settled by those of the lawyerly persuasion. But that was last week.

Yesterday, Alex updated his original post at Challengertalk.com with a picture of the keys to his new car and the following message:
First of all, "Thank You" to everyone for cheering me on and helping me move forward in a positive way. A lot of message boards picked up this thread and have to thank everyone for passing the word around too. There you have it. Visual of the keys in my possession of the SRT8 deal that Glenn E. Thomas Dodge honored for $29.1K plus tax and license fees of course.

Both parties had plenty to talk about that day but in the end of it all, things worked out for everyone. So there is praise to be made to both sides, especially the dealer who did honor the auction. Would encourage everyone to send them praise and not attack anyone in that establishment as this was not the point of this thread. I'm sure there will be questions on how things went down.
While swallowing a nearly $14,000 loss must be a bitter pill to choke down, we can all agree that in the end Glenn E Thomas did the right thing. Actually, they did better than the right thing, selling Alex a 2010 Challenger SRT8 rather than the 250-mile car he won in the auction. Put another way, in terms of positive publicity, this will turn out to be the best $14,000 they ever spent.

      Good for them. both sides. they obviously regretted the mistake, but at the same time they swallowed their pride and handed over the keys. even upping it to a newer version.

      wish the Hyundai dealership a few months back would have been this decent.

      Maybe someone there realized the GOOD publicity/advertising they would actually get from honoring the deal and decided to suck it up.

      To bump him up to a brand new 2010 is just insane though. I'm not even sure I understand that move. The news would have been just as awesome if they just gave him the car he had won.

        The 2009 is up for auction on eBay for $66k to recoup the loss.

        They can make more money selling used cars than they can new cars. AKA the dealership didn't lose 14k in profit but probably more like 8k or so.

      I'm pretty sure this got all the way up to Chrysler Corp. desk and they had a role in all of this which explains the 2010 model year...Thanks to the internet people have voices....

        And if the shoe was on the other foot, and the dealer got some sucker to pay $50,000 for this car (be it because of stupidity or a computer error on the buyer's part), they wouldn't be pushing the "LEGAL BINDING CONTRACT" clause on them.

        Never.
        A dealership has NEVER EVER screwed a customer.

        If you don't understand the concept of a legal binding contract, then I suggest you stay at home and let the adults take care of business.

      Let's calm down. These cars have, according to congressional testimony $750 worth of steel in them.

      Point being, they aren't worth even what he got it for!

      We've been getting hosed for years. This dealer didn't eat anything. They sell 40k trucks all day long on sale for 27k. If they can make that work, they can make this work.

      They were only butt hurt cuz it is a hot car and they could have hosed someone - instead he paid what he should have for $750 worth of steel.

      So some assfuk got lucky and screwed the dealer. whoopee doo.
      The dealer's lawyer's just told them it was cheaper to honor/eat the mistake than take it to court.

      I think the dealer should have let the case go to court and then countersued for misuse of process.

        I don't think i was clear, what i am trying to say is market value for this car is only $29k so that's how much consumers are willing to pay as witness by this auction. Obviously Chrysler will reduce the sticker price and hit it with rebates once it realizes no one will 40,000+ for this not so great car. So hopefully this sends a message to car companies to stop marking up the price of cars that not are that much.

        They didn't discount it. That is how auctions are run. You start off real low to entice buyers then you set a reserve price. A reserve price...because I am sure you have no idea what it is...is a price that is set so that if the auction ends with only two bids and the price is still low..the car is still yours. In this case, the Internet sales manager, who is the son of the owner, forgot to set the reserve price. So the auction ended and the auction is binding...as long as you have the money for a $3000 letter of intent to sue from a lawyer. In this case, Hitman had the money and so he could force a deal.
